Practical Courses - Terms & Conditions

Defintions

In the following sections ‘we’ and ‘us’ refers to Andante Yachting and ‘you’ refers to you, our customer.

Bookings, scheduling and deposits

Individual Bookings are accepted on a ‘first come – first served’ basis.
Whole boat bookings are normally individually scheduled unless a suitable scheduled event is empty at the time of booking.
Provisional bookings will be held for ten days and will then be cancelled unless they have been confirmed. A booking is confirmed by payment of a 10% deposit for a practical course and full payment for a classroom course. We will confirm your booking in writing.
For practical courses your deposit will only be refunded if you cancel within seven days of your confirmation or we have to cancel your booking. If you confirm your booking less than seven days from the start date and you then cancel your booking we will not refund your deposit.
If the booked start date is more than 30 days from the date that we issue your booking confirmation then the requirement on us to provide the service within 30 days is not applicable (The Sale and Supply of Goods to Consumers Regulations 2002).

Payments, prices and cancellation

Full payment must be received prior to the start date of your booking.
The boat’s operator or your instructor will issue your invoice and manage all course details. The full amount must be paid once you have been invoiced, unless specifically agreed to the contrary. The prices shown include VAT where required at 17.5%. If the VAT regulations are changed then we will amend our prices accordingly.

If you cancel, and we are able to resell your booking, we will refund all your payments apart from the deposit. If we cancel the course we will either refund all money that you have paid and cancel your booking or transfer it, with your agreement, to a different course.

Insurance

For practical courses you must have adequate insurance. It is your responsibility to arrange it. We may, at our discretion, check with you that you are insured.
Andante Yachting is properly insured but not for loss, damage or injury to you or your property. Things can get wet, broken or dropped overboard. Spectacles and cameras are good examples. Injuries can occur and people can become ill.
Adequate insurance is a condition of your starting any sailing activity with us. REMEMBER THAT YOU ARE LIABLE FOR THE OUTSTANDING BALANCE ONCE YOU HAVE BEEN INVOICED.

Smoking, alcohol and recreational drugs

We operate a total 'no smoking' policy whilst on board our boats.
For safety reasons we have a 'no alcohol’ policy while sailing and a total ban on recreational drug usage from the start of your course or sailing week to the time when it finishes.
If you contravene these rules we reserve the right to ask you to leave without notice.

Health and safety

The Personal Details form that we send to you is an important document. Completed forms for all members of your party must be returned to us at least one week before your booking starts.
We cannot accept responsibility for illness or accidents that are caused, or contributed to, by undisclosed health or medical conditions. Non- disclosure may result in our cancelling your booking without any refund.
The skipper’s decision is final on matters relating to sailing and safety. We will take every reasonable care to protect your safety. Lifejackets (and safety harnesses) must be worn and used when on deck and the boat is under way unless authorised by your skipper. You must take all reasonable care to minimise the risk of accident or injury both to yourself and the others on board.

Non availability

If we have to cancel your booking for any reason we will offer an alternative booking, or refund all payments (including your deposit) in full. This is the full extent of our liability to you.

Children

Children are welcome if their parents are with them and (a) they have adequate wet weather clothing, lifejackets and safety harnesses (we can advise on suitable equipment but do not supply it) and (b) their parents accept responsibility for them at all times.

Negligence

If, due to your negligence, items from the boat’s inventory are lost or damaged we may ask you to pay for, or contribute to, the cost of repair or replacement.

Loan of equipment

‘Oilskins’ and safety gear are lent on condition that you agree to pay for repair or replacement should any item be damaged or lost. We only have adult size equipment.

Whole boat bookings

We welcome them. If you have a party of up to four people and want to reserve a boat for your exclusive use then we would charge you as though there were four people on board. For a fifth person we charge the normal per person rate.

Start and finish

Normally from the agreed base unless otherwise specified in advance. If we have to terminate early or at a different harbour then we will refund your payments on a pro rata basis and cover reasonable expenses in returning to the point where you boarded the boat.

Students not resident in the UK

You are welcome. The total fee (in Sterling and net of all bank and currency conversion charges) that we receive must be the amount quoted. If you pay by credit card this will be handled for you.

General

We are registered under the Data Protection Act. We will not disclose information on our files about you unless we are legally obliged to or you have agreed in advance in writing. You confirm, by enrolling, that we may hold necessary business information about you. We will exclude you from our mailing list at your request.
Any contract between you and us shall be governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute. All dealings, correspondence and contacts between us shall be made or conducted in the English language
